TERMS & CONDITIONS

  1. TERMS & CONDITIONS:  These terms and conditions shall be incorporated into the contractual rights between you (the Customer) & us (Chef Nemo Ltd - "the Supplier") and shall apply in place of and prevail over any terms and conditions contained or referred to in any communication from you or implied by custom and practice.

  2. PRICES & PAYMENT: All prices are in £ sterling and include UK VAT at the appropriate rate (if applicable). Delivery charges are included in the prices quoted on this website unless the order value is below what is specified on our delivery page. We accept payment by most major debit and credit card companies excluding American Express. Payment is taken by the driver on delivery of the goods to your requested destination although payment can be made over the phone upon request. Once you have placed your order and we have established that we can fulfil your order, checked details and stock availability we will contact you to confirm delivery dates and times. The contract is subject to availability of stock.

  3. VARIATIONS: We reserve the right to make such amendments to the Contract as we think fit or to terminate the Contract should any information or data supplied by you proves to be inaccurate or incomplete in any respect. We also reserve the right to vary or alter the specification of the products without notice.

  4. TITLE: Title of the products shall not pass to you until we have received payment in full (in cash or cleared funds) all sums due in respect of the products and all other sums which become due to us from you on any account. Until title passes to you, you shall hold the products on a fiduciary basis as our bailee; store the products separately in such a way that they are clearly identifiable as the property of the Supplier and maintain the products in a satisfactory condition. In the event of non-payment by you, Chef Nemo Ltd and/or the Supplier and/or our agent shall have the right without giving notice and without incurring liability to enter your premises to take possession of the products to which title has not passed. This shall be without prejudice to any other legal right or remedies available to us.

  5. RISK: The risk of loss or damage to the products shall pass to you on delivery of the products.

  6. DELIVERY: We currently deliver within the London, Surrey, Sussex & Kent areas ("Our Delivery Zone"). We cannot guarantee delivery times but we will keep you advised of any delays where possible. We shall not be liable for any loss or damages arising as a result of failure to deliver products by a particular date or arising as a result of any cause out of our control. Time for delivery shall not be of the essence unless previously agreed in writing between you and Chef Nemo Ltd. Delivery is normally made to your place of normal residency unless stated otherwise. You should ensure that a responsible person is at the place of delivery to sign for the goods. If you fail to take delivery on the delivery date we may charge you the cost of the carriage of the refused delivery. Click Delivery for more details.

  7. DELIVERY COST: The delivery costs are included within our price subject to a minimum order & deliveries being made within Our Delivery Zones. Click Delivery for more details

  8. PURCHASING: All items offered on our website are subject to availability and price change. To purchase any of the items on our website,click the "Add to Basket" button on each product page. When you place an order to purchase a product by clicking the button "Checkout", we will send you an e-mail confirming receipt of your order and the details of your order. Your order represents an offer to us to purchase a product(s) and is accepted by us when we send e-mail confirmation to you that we accepted your order. A delivery contract will have formed between you and Chef Nemo Ltd at this point; when you take delivery of the goods and make payment whichever occurs earlier your contract with the Supplier takes priority. We keep the data confidential in accordance with our privacy policy.

  9. RETURNS: Under the distance selling regulations you have the legal right to cancel your order within seven working days of receipt of the goods. Where goods are delivered to a third party you will only be able to exercise this right if you are able to return to us the goods you ordered. If you cancel the contract within seven working days, the goods must be returned in saleable condition and returned to our place of business. If the goods are returned in saleable condition we shall provide you with a refund, subject to no more than 3/10ths of the goods having been removed and the remaining goods are still frozen a -18*C.

  10. CANCELLATION OF ORDERS: You may cancel your order at any time up to 1pm the day before delivery. We will refund any payment you may have made but reserve the right to make a charge of up to £9.95 to cover handling costs incurred by us.

  11. OUR GUARANTEES: All our products are guaranteed. If you have a cause for concern we will do our best to provide you with a replacement or another product of at least equal value. If no more then 3/10ths of the goods have been consumed and are returned to our place of business in excellent condition and you do not wish a replacement or alternative product we will provide a money back guarantee on the remaining items.

  12. WARRANTIES: We warrant that the food products by us shall comply with the Food Safety Act 1990 and all relevant UK legislation from time to time in force.

  13. LIMITATIONS OF THE SUPPLIERS LIABILITY: In respect of all food products, our liability shall be limited to food products consumed up to and including the "Best Before" and "Used by" date. We shall have no liability for any loss or damage suffered by you or another person as a consequence of any defect in the product caused by abnormal conditions of storage, treatment or handling or any negligence or wrongful act on your part.

  14. CUSTOMER SERVICES & COMPLAINTS: We sincerely hope that you never have cause to complain about our service or products. However, if you do, please call, message or email us. We will try to acknowledge your concerns within 1 working day, and say how we propose to resolve it within 5 working days.

  15. FORCE MAJEURE: We reserve the right to defer the date of delivery or reduce the volume of products ordered by you or to cancel the Contract without liability to you if we are prevented from or delayed in the carrying out of our obligations under the Contract due to circumstance beyond our reasonable control including without limitation any strike, lock-out or other industrial action, fire, explosion, flood, closure of motorways or other roads leaving no alternative route, unusually severe traffic congestion, loss of power or telecommunications systems or computer failure or breakdown.

  16. PRODUCT DECLARATION: The product photographs shown on this website are of the product once defrosted or cooked. Upon delivery all products come individually quick frozen and may vary slightly in appearance. Product information & cooking instructions are correct at the point of publication, but please read packaging upon delivery or contact us for confirmation.

  17. STATUTORY RIGHTS: These Terms and Conditions do not affect your statutory rights.

Referral scheme - Recommend a friend

  1. To be eligible for this referral scheme you must be an existing customer, who has placed an order, made payment & received delivery.

  2. You must supply us with the name, address, telephone/mobile number of the recommended customers.

  3. If your recommended customer remains non-contactable after 30 days the vouchers will not be awarded.

  4. Once your recommended customer has placed an order, made payment & received delivery a £5.00 unique voucher code will be sent for your attention and a £5.00 unique voucher code will be sent to your recommended customer: These vouchers can be used with special offers & sales unlike other vouchers codes.

  5. A further £5.00 unique voucher code will be sent for your attention once your recommended customer has placed an order, made payment & received delivery of their second order. A £5.00 unique voucher code will be sent to your recommended customer: These vouchers can be used with special offers & sales unlike other vouchers codes.

  6. In some cases, it may not be possible to deliver to your recommended customer if they do not live within our delivery zone. In this situation the offer is not valid.

  7. The recommended customers address must be different to your own.

  8. The recommended customer can not already be a customer of Chef Nemo

  9. You may recommend as many new customers as you wish.

  10. In the case where two or more persons recommend the same new customers the voucher will only be given to whoever recommended first.

  11. It takes a minimum of 1 week for your unique voucher code to be produced after your recommended customer has made payment & received delivery of their order. The same time frame applies to the recommended customer's unique voucher code.

  12. In the instance that a person recommended has previously been a customer with Chef Nemo Ltd then this cannot be classed as a recommended customer. In this situation the offer is not valid.

  13. These unique voucher codes can not be awarded to customers who were recommended prior to this referral scheme being implemented on 11th January 2018.

  14. These unique voucher codes can only be awarded when the recommended customer places, pays and receives delivery of the first and second order to their home address or any address that's different to the existing customer and that's within our delivery zone.

  15. We regret that first orders taken via our door-to-door sales representatives are not eligible for this scheme.

eGift cards & voucher schemes

  1. eGift cards or vouchers entitle customers to a discount off the current selling price of the products on this website (www.chefnemo.co.uk).

  2. eGift cards or vouchers can only be exchanged for goods or services of a higher value.

  3. Only one eGift cards or voucher per order can be accepted.

  4. All eGift cards and vouchers are subject to verification at time of presentation.

  5. eGift cards or vouchers cannot be exchanged for the equivalent cash value.

  6. eGift cards or vouchers are redeemable online by placing an order and can only be redeemed in the currency of issue.

  7. New Subscriber Voucher codes are valid for one person per household for orders of £60 and over. They can not  be used in conjunction with special offers & sales.

  8. eGift cards and vouchers are valid up to the expiry date indicated. If you wish to use an expired eGift cards or vouchers please contact us before making your order otherwise it will be treated as void.

  9. Chef Nemo Ltd reserves the right to refuse to accept an eGift cards or voucher which it deems to have been tampered with, duplicated, damaged or otherwise is suspected to have been affected from fraud.

  10. All eGift cards or vouchers related terms & conditions published on this website supersede those on printed material. Your statutory rights will not be affected.

  11. Chef Nemo Ltd reserve the right to change, amend or withdraw eGift card and voucher terms and conditions without prior notice. Your statutory rights will not be effected.

  12. eGift Cards will expire after 2 years if not used, but can be reactivated upon request. Please contact us to reactivate your card.
